STOP PRESS Letter from Peter Spencer (JG member) to the Prime Minister!

Dear Prime Minister.

I have lost my land at Saarahnlee as a result of Commonwealth and State laws unreasonably restricting my use of that land so that the Commonwealth could harvest the carbon from the vegetation and vast forests on the property.

You may recall the letter sent to your Government regarding this injustice at the time of the Copenhagen IPCC meeting at the end of November 2009. The letter addressed to The Hon Kevin Rudd the then Prime Minister, was sent just prior to my protest regarding the injustice against me and thousands of farmers - this matter has still not been addressed. See a copy of my letter. Annexure A.

Unfortunately I received no satisfactory response to this appeal from your predecessor in particular or the Commonwealth Government. Annexure B page 6.

According to public reports, planned Bills and Bills passed - now Acts and Bills on the floor of the House, which I have seen, it appears that your Governments action will result in laws which will enable the trading of Carbon Certificates which will result in the loss of any possibility of the recovery of payments due me and is in my case argued, not the Commonwealth’s property to trade.

The carbon referred to is included in the carbon accounts to the UNFCC to enable the Australian Government to meet its International Treaty obligations and it is alleged, these accounts include my carbon. The Court has said in regard to this claimed property, that I have an arguable case.

This letter is to request your assurance that your Governments current actions will cease so that legislatively no trading in Carbon Certificates can be legitimised that would enable trading of any kind or the transferring of Carbon Certificates or carbon as property, by any means whatsoever, until the Court has finalised their deliberations on the matter.

Subsequently this will ensure my property is not compromised until the Court has handed down its decision.

In the event I do not receive these assurances within 7 days, I will take what steps are necessary to prevent further erosion of my rights pending final hearing regarding my property.

Here is the letter that I am going to send to the PM. Peter Spencer has allowed me to use a lot of his wording but I have adapted it somewhat. Peter suggested that I place it on this site to encourage others to do the same.

As these accounts to the UNFCC may include the carbon on our property and that of other landowners we ask that your government should wait until the Court has handed down its decision in the Spencer v Commonwealth case before proceeding further with carbon trading of any description. This case is due back in court supposedly on the 2^nd September 2011.

The carbon locked up in the trees on our property and that of other landowners is not the Commonwealth’s property to trade.

The Court has said in regard to Spencer V Commonwealth that Spencer has an arguable case.

This letter is to request your assurance that your Governments current actions will cease so that legislatively no trading in Carbon Certificates can be legitimized that would enable trading of any kind or the transferring of Carbon Certificates or carbon as property, by any means whatsoever, until the Court has finalized their deliberations on the matter.

We look forward to an urgent reply to our letter.

Hello Ruth, Excellent Assessment by Professor Suri, I attended 2 of his presentation and his expertise is invaluable. We will be at the Canberra Rally on 16th August, hope to see June Weston and yourself there.

Talking to Peter this morning and the 7 days - is no idle threat.

They have been mucking him about for 4 years in the hope that he would go broke ' give up or go away.

They don't know Peter Spencer like I do!

Rob, is Peter cc-ing (via email or other) a copy of his letters to Quentin Bryce?

I would imagine he is but I thought I would ask instead of trying to wade through the site to find any reference. And has he ever made contact with the UNODC?

Has he challenged the laws in his matter via McClennan?

There is a reason for my questions.

I think the attorney General got a copy but not the GG. The next step if he is ignored is a trip to the judge for an injunction-I beleive.

Federal Attorney Or State? That is important also.

Have Peter send a copy to the GG as soon as possible (email and send a hard copy) with an out-line of his matter and what he is trying to achieve. Ask for her intervention. Thats step one. MAYBE??

I can verify that Rob,

The man is completely incapable of making an idle threat. That gene doesn't exist in Peter's DNA.

There are a few who have different views to the Party line but probably need support to make their views sustainable for them.

I would assume he has similar views to myself on this Carbon Tax not achieving diddle squat with immigration set at the present level by Labor. He will have read the document in the PDF in the link below which confirms/supports immigration destroys value of environmental gain.
