STOP PRESS Letter from Peter Spencer (JG member) to the Prime Minister!

Dear Prime Minister.

I have lost my land at Saarahnlee as a result of Commonwealth and State laws unreasonably restricting my use of that land so that the Commonwealth could harvest the carbon from the vegetation and vast forests on the property.

You may recall the letter sent to your Government regarding this injustice at the time of the Copenhagen IPCC meeting at the end of November 2009. The letter addressed to The Hon Kevin Rudd the then Prime Minister, was sent just prior to my protest regarding the injustice against me and thousands of farmers - this matter has still not been addressed. See a copy of my letter. Annexure A.

Unfortunately I received no satisfactory response to this appeal from your predecessor in particular or the Commonwealth Government. Annexure B page 6.

According to public reports, planned Bills and Bills passed - now Acts and Bills on the floor of the House, which I have seen, it appears that your Governments action will result in laws which will enable the trading of Carbon Certificates which will result in the loss of any possibility of the recovery of payments due me and is in my case argued, not the Commonwealth’s property to trade.

The carbon referred to is included in the carbon accounts to the UNFCC to enable the Australian Government to meet its International Treaty obligations and it is alleged, these accounts include my carbon. The Court has said in regard to this claimed property, that I have an arguable case.

This letter is to request your assurance that your Governments current actions will cease so that legislatively no trading in Carbon Certificates can be legitimised that would enable trading of any kind or the transferring of Carbon Certificates or carbon as property, by any means whatsoever, until the Court has finalised their deliberations on the matter.

Subsequently this will ensure my property is not compromised until the Court has handed down its decision.

In the event I do not receive these assurances within 7 days, I will take what steps are necessary to prevent further erosion of my rights pending final hearing regarding my property.

Maybe a lot more of us should send letters also to the PM to ask if the carbon in the trees on their property has also been included in the accounts to the UNFCC and to state that we are waiting for the result of the court case Spencer Versus Government as we also consider that the carbon in our trees on our land actually belongs to us and not the government. We also insist that the government should cease any idea of carbon trading until the court case has been resolved.

Exactly Carol,

19% of Native Vegetation on Private land has been sterilized in order to satisfy the -under 108% next year on the 1990 levels. The minor detail is that "Just Terms" weren't paid and if the Feds hadn't stolen the credits they will be up for MASSIVE fines next year due to Rudd signing KYOTO in 2008.

If the B/wanksters get there bills through the senate in the next three weeks - Turnbull and all his mates will be trading AIR on July 1st next year.

This gives OUR CONVOY a whole new meaning and sense of urgency!!

The Federal Coalition has made a lot of noise about how bad the “Carbon Tax” will be for the economy.

If the coalition is fair dinkum about preventing this tax from ever seeing the light of day, they will have to get their State counterparts to scrap the Native Vegetation Act completely.

The scrapping of the Native Vegetation act will give this carbon back the real owners of the carbon, the landowners, thus forcing the Federal Government to purchase the carbon that they have allegedly stolen from the farmers. At $23 a tonne they simply will not be able to afford the millions of tons of carbon on the 109 million hectares of freehold land.

It seems pretty straight forward to me. This is an unconstitutional taking of property. I think there should be and is a legal avenue available to Peter in this circumstance, which will have the effect of stopping the implementation pending a high court decision on the matter.

Brave words and action from Peter Spencer! I so admire Peter's courage to STAND HIS GROUND. Surely truth is on his side!

And Thomas, you are right of course about the $23 being just 'a starting point'. It's just the thin edge of the wedge to try to avoid too huge an outcry, then who knows where it will end.

Peter’s fight over the injustice’s inflicted by the Green Agenda should be heralded as the rally cry for all Australian’s to stand up & unite against bad Government, bad policy, mandated by faceless bureacrat’s.

Peter Spencer is a Hero unlike KR who is not man enough to face him eye to eye.

The Native Vegetation Conservation Act drafted and introduced by Bob Carr's Government 1997 is what has 'crippled' lanowners. My understanding is the then Federal Government Howard 'encouraged' NSW Government to adopt Native Vegetation because if it's state law then State's do NOT have to compensate as opposed to the Commonwealth gaining a benefit in meeting it's Kyoyo Emissions Target thus gaining a benefit then the Commonwealth are obliged to pay. The Nationals said prior to the March election this message which I have on my mobile quote " The Nationals have always opposed Labors Native Veg Laws & theft of Property Rights ans that will direct our actions in Government, signed Andrew Stoner" unquote. I want to see this happen now. Jeanette Jones.
