Update:  Szulc was imprisoned again, this time for 15 months.  Updated discussion starts on page 10.

 

Gaoled for three months (26 July 2010) for contempt of court, bachelor Maxwell Szulc, who thought he was going to Perth for a hearing but ended up in handcuffs and unable to go back home, must be worried about his cows and sheep, not to mention the food in his fridge and how to pay his bills while in prison.

A battler, Mr. Szulc, 62, shore sheep and worked the mines, developing his (or what he THOUGHT was his) block of land near Esperance in WA as time and money permitted. He cleared regrowth on his land, most recently 40 hectares of fire breaks, after an injunction was sought by DEC to keep Mr. Szulc from using his property. It was this 40 hectares of firebreak that landed Mr. Szulc in prison.

"The department said Chief Justice Martin issued the injunction in October last year after the DEC demonstrated to the court that it had exhausted all reasonable avenues of engagement and regulation to stop Mr Szulc from unlawfully clearing native vegetation on his property.

"The DEC said Mr Szulc had cleared a total of 345 hectares of native vegetation from the property without authority but that it was the 40ha Mr Szulc cleared after the court injunction that landed him in jail.
"

The word Esperance means "hope." Without the foresight of settlers who saw hope in that area, without doers who figured out that the land would be productive with some superphosphate and trace mineral additions, the Department of Environment and Conservation would not even know Esperance existed.

Hope. It is the hope that common sense will prevail...that right can and will triumph over might...that my children will know the real meaning of the term "justice"... that keeps me from despair.

Esperance. Hope. In hope, we will be rallying around Maxwell Szulc and the principle of the sanctity of private property rights. In the mean time, please spread the word and inform yourselves. With the level of incompetence in the DEC, they are in NO position to be pursuing farmers like Max Szulc to jail for maintaining firebreaks on his own personal property.

Sounds about right Janet.

However, in a Tasmanian school the same progressive maths lesson can only proceed when the teacher regains her composure after becoming visibly upset by the thought of trees being assaulted by nasty men.
The lesson is conducted by first reinforcing the idea that such questions are properly answered by urging the class to identify those fellow students who should feel pressured to confess the fact their fathers assist in the killing of trees for selfish reasons.


The answer to be given by those classmate beneficiaries of "eco-vandalism".

The defendant students must explain to the class, the excuses their tree killing capitalist fathers hide behind.
The lesson being that calculating the profit margin of "crime" is correctly performed by communal consideration of the profiteers confessions.

(Ps, My daughter was recently required to explain why we tail dock the cute little lambs.)


Also, in response to IanMY.  I did ask once, if long division was still taught. The answer was, "When would they need to use that at home?"..... No joke! That was the answer.

Unfortunately the likely outcome of this debacle is that, instead of releasing Max Szulc from jail and giving farmers liberal permission to clear firebreaks wherever they choose on their own properties, ALL controlled burns may be cancelled across the State even in the winter months - making the situation even more dangerous in future years.

Pity the victims couldn't get a class action against the DEC and get Max's plight involved at the same time!

Not a bad idea. If the DEC are forced to pay out all the fire-victims, they should have much less money to pursue hard-working farmers like Max Szulc to jail - until they can raise more taxes.

We don't gaol Political Prisoners in Australia.

Mr Szulc was gaoled for a contempt of court action arising from him exercising his rights to political protest.

Write to the Premier and Attorney General of WA, asking that they exercise the Royal Prerogative of Mercy in Maxwell's case.

Also bring this to the attention of Amnesty International in Australia. They would not tolerate this happening in a third world country, why are they tolerating it happening here?

Does anyone have news on Maxwell? Is he still in gaol? Has he been released? I would most appreciate an update. He must be due for release fairly soon if he is still there?

Sadly - no  Jo.

             Matt and Janet were our main advocates in the west and nobody did more for the cause than yourself  and M&J. We should all get moving and make some enquiries on Monday.

Fires and firebreaks certainly are topical at the moment!

Will try to give janet a ring in the morning, see if she has heard anything.

Thanks Rob and Cate, I've emailed Janet, and Barry Corke. It appears Maxwell is still in gaol, and may be released around Feb 10, but there is some uncertainty about that.
